The Homemaker Who Discovered Her Husband's Investments: Why Nomination Matters

For over two decades, Sunita left family financial management entirely to her husband. He managed household budgeting, handled bank deposits, and invested in equities and mutual funds. While she knew investments existed, she never inquired about specific folios, depository accounts, or operational access procedures.

Following her husband's unexpected passing, Sunita was confronted with stacks of paper records, fragmented bank statements, and unfamiliar demat account notices. Coping with grief was compounded by financial uncertainty.

Understanding Transmission Vs Transfer

With the assistance of a registered Depository Participant (DP) and mutual fund registrar, Sunita initiated the legal process of securities transmission.

Transmission of securities refers to the operational transfer of assets held by a deceased investor to a surviving joint holder, registered nominee, or legal heir by operation of law. Unlike a market sale or voluntary transfer, transmission occurs without commercial transaction charges.

The Critical Value of Nomination

Fortunately, Sunita's husband had formally registered her as nominee across his primary demat account and mutual fund folios. Nomination empowers a designated individual to claim securities or redemption proceeds upon the investor's demise. Where nominations are properly registered, transmission proceeds smoothly with standard documentation (such as an attested death certificate and claimant KYC). In the absence of a registered nominee, legal heirs must obtain succession certificates, letters of administration, or execute extensive indemnity bonds, significantly delaying access.

Essential Financial Checklist for Families

  • Distinguish Folios from Demat Accounts: Mutual fund holdings may exist in statement-of-account (SoA) format under an AMC folio or in dematerialized form within a demat account. Maintain an updated central ledger of all account numbers.
  • Verify and Update Nominees: Periodically check that nominees are registered across all demat accounts, mutual fund folios, provident funds, and bank accounts.
  • Consolidate Centralised Documentation: Ensure your spouse or trusted family members know where physical certificates, login credentials, and account records are securely stored.
  • Track Dormant and Unclaimed Assets: Unclaimed dividends or shares transferred to the Investor Education and Protection Fund (IEPF) can be reclaimed by eligible legal claimants following the prescribed verification procedure.
